1. Identification of the owner of the Honest Greens Websites and App

The owner of the websites https://honestgreens.com and https://www.hg.uk (hereinafter, the "Websites") and the Honest Greens App, which refers to the official mobile application developed and managed by HONEST GREENS, BARCELONA, S.A.U., available for mobile devices with Android and iOS operating systems, which can be downloaded and used exclusively through the official Google Play Store and Apple App Store platforms, respectively (hereinafter, the "App") is the following commercial company:

For the purposes of this Legal Notice and the other Legal Texts to be defined below, the aforementioned commercial company HONEST GREENS BARCELONA, S.A. will be referred to as "HONEST GREENS".

2. Honest Greens Companies

The following are the companies that operate Honest Greens restaurants and provide services through the App and the WebApp https://app.honestgreens.com and https://www.hnst.app (hereinafter, the WebApp):

For the purposes of this Legal Notice and the other applicable Legal Texts to be defined below, the companies included in the table above shall be referred to collectively as the "HONEST GREENS companies" and individually as the corresponding "HONEST GREENS company".

Outside of the App and the WebApp, the only company operating the Websites is HONEST GREENS.

3. Purchases, prices and contracting

Purchases of products and services offered through the App and the Websites (via the WebApp) shall be understood to be formalised directly between the user (i.e. the person who browses and interacts with them – hereinafter, the User) and the HONEST GREENS company that manages the corresponding restaurant, in accordance with the information available at the time of contracting.

HONEST GREENS, as the commercial company that owns the Websites and the App, acts exclusively as a provider of the technological platform that facilitates contact between the User and each restaurant, without intervening as a contracting party in such operations or assuming any responsibility for the sale of products or the provision of services by HONEST GREENS companies or other third parties.

HONEST GREENS BARCELONA, S.A. and the HONEST GREENS companies shall act, where applicable, as joint controllers of personal data processing under the terms of Article 26 of the GDPR, as indicated in the Privacy Policy, and as a contracting party, the company operating the corresponding restaurant according to the order related to the corresponding HONEST GREENS company indicated in the table above or in relation to job offers.

The User may consult the specific terms and conditions applicable to each transaction —including prices, taxes, additional costs and special conditions— during the contracting process and prior to acceptance, through the Legal Texts detailed below and available on the App and WebApp, without prejudice to the confirmation subsequently received regarding the transaction carried out.

Prices are displayed and charged in the currency of the country where the relevant HONEST GREENS company provides the service or sale (EUR in Spain and France; GBP in the United Kingdom), inclusive of applicable taxes and charges, as set out in the Terms and Conditions.

4. Privacy policy

The personal data provided by Users will be processed by HONEST GREENS and HONEST GREENS companies in accordance with the Privacy Policy, available on the Websites and in the App.

User rights: you may exercise your rights of access, rectification, erasure, objection, restriction and portability, as well as the right not to be subject to automated decisions and the right to access the data generated by the App/WebApp (Data Act). You can exercise these rights by writing to hello@hg.uk.

5. Use of cookies

The Websites and the App use their own and third-party cookies for technical, analytical and advertising purposes, in accordance with the provisions of our Cookies Policy, accessible in both environments.

Users may manage their consent and configure the use of non-essential cookies through the preferences panel enabled for this purpose, in accordance with current regulations on data protection and information society services.

6. Use of artificial intelligence (AI) systems

Certain functionalities may be automated using artificial intelligence (AI) systems, in accordance with Regulation (EU) 2024/1183 (AI Act). These technologies may be used for (i) personalised recommendations, (ii) automated customer service and (iii) analysis of usage patterns. HONEST GREENS guarantees that no decisions will be made based solely on automated processing that produces legal or significant effects without human intervention.

In particular, AI technologies may be used for:

• Suggest products based on the User's consumption history;
• Display automated messages on the digital customer service channel;
• Optimise design or navigation based on usage patterns.

When the User interacts directly with an automated system (e.g., a virtual assistant), they will be expressly informed that they are not interacting with a natural person, in accordance with the provisions of the AI Act.

HONEST GREENS and HONEST GREENS companies do not make decisions based solely on automated processing that produces legal effects or significantly affects the User without prior human intervention, except in cases where it is legally permitted and with the corresponding information and guarantees.

7. Intellectual and industrial property

All intellectual and industrial property rights over the App and the Websites, as well as over their contents —including, but not limited to, the graphic design, source code, texts, images, videos, databases, trademarks and other distinctive signs— are the exclusive property of HONEST GREENS or its licensors, and are protected by applicable national and international legislation. All rights reserved.

Any use, reproduction, extraction, indexing, downloading, distribution, public communication, transformation or any form of exploitation, in whole or in part, of the content without the prior and express authorisation of HONEST GREENS is expressly prohibited, except in cases where it is legally permitted.

In particular, the use of automated systems or data extraction technologies—including crawlers, bots, spiders, scrapers or artificial intelligence tools—for the purpose of collecting, copying, indexing or training algorithms or artificial intelligence models based on the content of the App or the Websites is prohibited, unless expressly authorised in advance by HONEST GREENS.

HONEST GREENS reserves the right to implement technical protection measures (including the use of the robots.txt file) and to take all legal action available against any unauthorised use of its content or infringement of its intellectual or industrial property rights.

This reservation of rights shall be understood without prejudice to legally recognised exceptions or legitimate uses, in particular those provided for in Articles 3 and 4 of Directive (EU) 2019/790 and Regulation (EU) 2023/2854 (Data Act), provided that such uses comply with their specific conditions and purposes.

8. Terms of use of the Websites and App

Access to and use of the App and Websites implies full acceptance by the User of this Legal Notice, as well as the Terms and Conditions, the Privacy Policy and the Cookies Policy (collectively, the "Legal Texts" referred to above).

The User undertakes to make diligent, lawful and good faith use of the App and the Websites. It is prohibited to perform any act contrary to the law, the rights of third parties or the aforementioned Legal Texts.

HONEST GREENS and HONEST GREENS companies shall not be liable for damages resulting from technical failures, errors in the configuration of the User's software or interruptions not attributable to their actions, to the extent permitted by applicable regulations.

9. Applicable legislation and competent jurisdiction

• HONEST GREENS (parent company): When the User interacts with HONEST GREENS BARCELONA, S.A., Spanish law shall apply and the competent courts shall be those of Barcelona.
• HONEST GREENS Restaurants (Spain and France): When the User purchases products or services at a restaurant managed by one of the HONEST GREENS companies identified in this Legal Notice, the law and courts of the domicile of said company shall apply (e.g. French consumer law and regulations and the courts of Paris for the Paris restaurant).
• HG Restaurant (United Kingdom): When the User purchases products or services at restaurants in the United Kingdom, English law shall apply and the courts of England and Wales shall have jurisdiction, with access to alternative dispute resolution mechanisms (ADR/NCDR), without prejudice to the rights granted to consumers by the Consumer Rights Act 2015.
• Consumers: In any case, if the User acts as a consumer, la legislación y jurisdicción de su residencia habitual prevalecerán cuando esto le proporcione mayor protección, de acuerdo con la normativa de la UE y, en su caso, la normativa del Reino Unido.
• Businesses or professionals (B2B): In all other cases, the parties submit to the Courts and Tribunals of the city where the registered office of the company with which the product or service subject to dispute has been contracted is located, expressly waiving any other jurisdiction.

11. Modifications to the Legal Notice and other Legal Texts

Substantial modifications to this Legal Notice and other Legal Texts (Privacy Policy, Terms and Conditions) will be communicated 15 days in advance, requesting express acceptance when required by law . Users may cancel their account without penalty if they do not accept the new conditions.
